From Silence to Storm: DHFL Victims’ Fight Beyond the Saffronized Judiciary

Posted on 4th April, 2025 (GMT 08:52 hrs)

Dear Fellow DHFL Victims,

We stand at the crossroads of despair and defiance, waiting for our Godot. Like characters in a Beckett play, we linger in the shadow of uncertainty, clutching the faint hope that justice might still dawn. The Supreme Court of India, in its April 1st, 2025, verdict, has cast us back into the labyrinth of litigation, overturning the NCLAT’s January 27, 2022, ruling that once glimmered as a beacon for us, the financially ravaged victims of DHFL. For what purpose, we ask?

Perhaps to weave a cloak of legality around Mr. Piramal’s alleged adverse possession of DHFL, a prize he seeks to claim through the slow grind of a 12-year clock. Or perhaps to chain us to this endless domestic treadmill, thwarting our cries from reaching the hallowed halls of the United Nations Human Rights bodies. Whatever the intent, we wait—our ears filled with the haunting strains of John Cage’s “Waiting”,

This is a melody that mirrors our suspended existence. And as its notes drift through us, questions rise like specters in the silence: What remains undone? What can still be forged anew?

WHAT REMAINS TO BE ACHIEVED? WHAT OPPORTUNITIES STILL EXIST? WHAT TASKS ARE LEFT UNFINISHED?

Cast aside the shroud of hopelessness—it is still too early to surrender. When every domestic remedy lies exhausted at our feet, we shall turn our gaze to the United Nations, to the Office of the High Commissioner for Human Rights (OHCHR), and demand the justice denied us here. We see through the charade: a judiciary, allegedly entwined with the powers that be, has tossed our case back to the NCLAT, commanding it to begin again from the ashes. Is this not a ploy to stretch our suffering across a dozen years, until Mr. Piramal’s grasp on DHFL hardens into “law”? A stalling tactic to keep our voices from echoing on the global stage?

The Insolvency and Bankruptcy Code, heralded as a swift salve for financial wounds, has proven a cruel mirage. Five years we’ve wandered this desert of delay, only to stumble into the Supreme Court’s maddening verdict—a bitter fruit of frustration. But let this not be our elegy. Let it be our battle cry.

Fellow victims, the time is ripe to channel this fury into action. Join the swelling tide of our non-violent, web-based civil disobedience, unfurling our banners across every digital frontier under the OBMA’s steadfast umbrella. Amplify our story on every platform—let the world hear our roar.

For those who can, beyond the screens, let us call upon event managers to orchestrate our defiance in the streets: placards piercing the sky, slogans resounding through the air, songs and plays enlivening our struggle, hunger strikes etching our resolve into history.

This post-verdict anguish is not our defeat—it is the spark of our resurgence. We are not solitary souls adrift; we are a united front, unbreakable in the face of every storm. Let us dismiss the installed black sheep in the DHFL movement (One of them being a so-called self-proclaimed “national convener” of the DHFL FD Holders), who seek to divert us from our movement’s shared goal. Together, let us transform this waiting into a rebellion, this silence into a powerful symphony of resistance.

With Comradely Greetings,

Once in a Blue Moon Academia (OBMA) Founder-Members

We would greatly appreciate a donation of Rs. 1 (or more, depending on your capacity and commitment to our cause) for each victim shown in the following QR code, which will help us advance our web and/or street initiatives aimed at creating organized networks for protest and dissent. It is too expensive for us to carry on all these activities without even a minimal amount of crowdfunding.
